Affiliate Program Agreement

5. Acceptable Use of Traffic and Promotion

Last modified: June 15, 2025

Compliance with General Guidelines: The Affiliate shall comply with all policies, guidelines, and reasonable instructions that Babelix may issue or communicate from time to time regarding participation in the Program, use of Affiliate Links, promotion of Babelix services, or use of Promotional Materials.

The Affiliate agrees to promote Babelix and generate traffic to Babelix websites in an ethical, legal, and responsible manner.

The Affiliate may promote Babelix through various means (such as websites, blogs, social media, and email marketing), provided they comply with the following acceptable use policies.

Babelix expressly prohibits any method of generating traffic or leads that is fraudulent, deceptive, or harmful.

The following defines non-permitted practices (this list is not exhaustive):

5.1 SPAM Prohibited

Sending unsolicited commercial communications (spam) to promote Babelix is not permitted.

This includes, but is not limited to, sending unwanted mass emails, unsolicited messages on social media or messaging applications, abusively posting referral links in comments, forums, or other third-party platforms, or any other activity that violates anti-spam laws (such as the U.S. CAN-SPAM Act or other applicable laws).

The Affiliate must obtain prior consent from recipients before sending promotional communications via email or similar means and must include opt-out options where applicable.

5.2 Offensive or Deceptive Communications

In addition to the prohibition of SPAM, the Affiliate shall refrain from sending electronic communications (email, messages, etc.) related to the promotion of Babelix that are harassing, threatening, obscene, offensive, or that use falsified or misleading sender information, headers, or subject lines to conceal the origin or nature of the communication.

5.3 Automated or Fraudulent Traffic

Using bots, click farms, automated scripts, page auto-refresh, or any artificial mechanism to generate visits, clicks, or subscriptions on Babelix is strictly prohibited.

All referrals must originate from genuine human users with legitimate interests. Likewise, device spoofing, using VPNs or proxies to simulate locations, and using false information or fictitious identities to generate subscriptions are not permitted.

The interested user must complete any registration form directly; the Affiliate must not complete registrations on behalf of third parties.

5.4 Use of Pop-ups, Interstitials, and Deceptive Redirects

The Affiliate is expressly prohibited from using pop-ups, pop-unders, interstitial ads, automatic or deceptive redirects, or any other form of advertising, software, or intermediary webpage that imposes itself or interferes with the user’s click on the Affiliate’s promotional link and the designated landing page on the Babelix website.

This prohibition includes, but is not limited to, the use of scripts, adware, or any software that forces the opening of additional advertising windows or redirects user traffic in a non-transparent or non-consensual manner.

5.5 Malware Distribution

It is strictly prohibited to use affiliate links or engage in any promotional activity related to Babelix that distributes, propagates, or links to any type of malicious software (malware), including but not limited to viruses, worms, trojans, spyware, adware, or ransomware.

The Affiliate shall not use Babelix affiliate links in direct connection with the publication, transmission, storage, or dissemination of defamatory, libelous, or illegal pornographic material beyond what is already covered in the clause regarding Illegal or Inappropriate Content.

5.7 Incentivized Traffic

Offering incentives, rewards, payments, or other benefits to third parties in exchange for them taking actions on Babelix (e.g., registering or purchasing a subscription) is not permitted. This includes offering users cash, gift cards, points, coupons, rebates, or any direct financial compensation in exchange for subscribing to Babelix through their affiliate link.

Such incentivized traffic practices can lead to low-quality or fraudulent leads and are prohibited to protect the Program’s integrity. (Note: This does not prevent the Affiliate from offering non-monetary bonuses permitted by law, such as additional content or their own site’s services, provided such bonuses do not constitute a payment or discount on the Babelix price.)

5.8 Keywords, Domain, and Brand

Without prior express written approval from Babelix, the Affiliate may not use the “Babelix” trademark (or similar variations or translations) in domain names, subdomain names, meta-tags, pay-per-click (PPC) advertising campaign names, or search engine keywords.

Nor may the Affiliate acquire domains or URLs that mimic official Babelix sites. Any unauthorized use of Babelix’s trademarks, trade names, logos, or domains shall constitute a serious breach of this Agreement. The Affiliate shall also refrain from creating web pages, profiles, or social media groups that could cause confusion with Babelix or appear to be an official representation of the Company.

5.9 Deceptive or Unethical Advertising

The Affiliate must not make false, misleading, or exaggerated statements about Babelix, its services, or its policies. Any promotional material must truthfully describe Babelix’s services without misleading users.

For example, Babelix will not tolerate erroneous claims about premium subscription features or promises that Babelix does not actually fulfill (such as “guaranteed sugar daddy in 24 hours,” etc., if such promises are not part of the official offer).

Likewise, using negative or defamatory content to attract referrals is prohibited. Promoting Babelix by calling it a “scam,” “fraud,” or using derogatory language with the apparent intention of then recommending it is not allowed.

This “negative advertising” tactic to generate curiosity harms the Company’s reputation and violates this Agreement.

5.10 Accuracy of Pricing Information

Suppose the Affiliate displays Babelix subscription or service prices in their promotional materials. In that case, the Affiliate is solely responsible for ensuring that such information is accurate and kept up-to-date according to the official prices published on the Babelix Website.

Babelix will not be liable for any claim or damage arising from incorrect or outdated pricing information displayed by the Affiliate.

5.11 Illegal or Inappropriate Content

The Affiliate shall not promote Babelix on media containing illegal material, obscenity, hardcore pornography, hate speech, extreme violent content, or any content that Babelix, at its sole discretion, deems harmful to its image or contrary to law and decency.

If the Affiliate’s site or platform includes legal adult content (e.g., blogs about adult dating), it must include proper age warnings and comply with all applicable laws.

Babelix expressly prohibits the Affiliate from using the Program to promote, facilitate, or engage in any form of prostitution, human trafficking, or people trafficking. Any indication of promoting illegal activities resulting from the Affiliate’s participation will result in the immediate termination of the account.

5.12 Other Prohibited Methods

The use of “cookie stuffing” techniques (inserting tracking cookies without user knowledge), covert iframing of the Babelix page, typosquatting (using brand misspellings to divert traffic), as well as the generation of form auto-fills or any form of technological manipulation intended to simulate real traffic or conversions deceptively is prohibited.

Likewise, the Affiliate shall not reverse engineer, scrape data, or use automated tools to collect information from Babelix (such as user lists) for unauthorized purposes.

Babelix reserves the right to monitor Affiliates’ traffic sources and promotional activities. If the Company detects (or has reason to suspect) that an Affiliate is engaging in any of the prohibited practices mentioned, it will take action.

In that case, it may take immediate corrective action, including temporarily suspending the affiliate account pending investigation, voiding improperly obtained commissions, or immediately terminating the Affiliate account for serious breach, as detailed in the Termination section.

Babelix may, at its discretion, reject traffic originating from certain Affiliate sources if it deems it potentially harmful. The Company may block or redirect traffic originating from the Affiliate to other sites or pages at any time and for any reason (or no reason).

In such an event, the Affiliate’s sole recourse, if they disagree, shall be to cease sending traffic or terminate their participation in the Program (without this entitling them to any compensation).

In addition to the prohibitions and guidelines contained in this Section 5, the Affiliate agrees to review and strictly comply with all additional policies, restrictions, and requirements detailed in “Annex A: Babelix Affiliate Program Promotion Policy and Restrictions,” which forms an integral part of this Agreement and contains important specifications, particularly (though not exclusively) concerning Pay-Per-Click (PPC) Advertising and keyword usage.
